THE VILLAGE OF BURK’S
FALLS
COUNCIL MINUTES
The regular meeting of the Burk’s Falls Council was called to order at
7:00 pm on Tuesday, January 27, 2009 in the Burk’s Falls Council
Chambers.
Present were Reeve Cathy Still, Councillors Rex Smith, Ron Russell,
Bruce Campbell and Lewis Hodgson. Councillor Russell declared a conflict
on the MTO item for discussion.
Delegations:
Steve Napper regarding debris falling off the recycling truck. It was
suggested that a mesh tarp or some other means of keeping material from
littering the roadside would be implemented.
Cindy Bourguignon regarding waterfront development. She has got
permission to have the Legion for a night to hold a fundraiser. She is
requesting the use of the theatre for an evening for a music
extravaganza for another fundraiser. Councillor Hodgson will work on the
details with Cindy.

2009-01
B. Campbell – Ron Russell
That we adopt the Minutes of the December 16, 2008 Meeting as
circulated.

2009-02
Rex Smith – Ron Russell
That the Council for the Village of Burk’s Falls supports the AMO
position on the Waste Diversion Act and the Blue Box Program Plan review
and will forward our support to the Minister of Environment for the WDA
and for the BBPP.

2009-03
B. Campbell – Ron Russell
The Council for the Village of Burk’s Falls supports the payment of
$0.30 per capita to the Women’s Own Resource Centre.

Council approves the advertising contribution of $ 100.00 plus GST in
the Almaguin News for the Volunteer Fire Department Special section
being prepared.

The Council for the Village of Burk’s Falls accepts the Contract from
Metroland North Media for advertising services as presented in the
amount of $ 157.50

2009-06
B. Campbell – Ron Russell
The council is aware that the Village received some invoices that must
be paid prior to Council meetings because of penalties for late
payments.
Council is also aware that the Treasurer pays for janitorial services
bi-weekly and employees wages every second Friday.
Council authorizes the Treasurer to issue cheques for the above as and
when required throughout 2009. The Council also authorizes the
Clerk/Treasurer to purchase necessary stationary supplies, printing
supplies and other office materials that are required to efficiently
operate the Municipal office from day to day throughout 2009.

Ron Russell – Rex Smith
The Council for the Village of Burk’s Falls authorizes the Reeve, Cathy
Still and the Clerk/Treasurer, Jarvis W. Osborne be authorized to submit
a financial request to the Department of Canadian Heritage in relation
to the Celebrate Canada Program for organizing activities to celebrate
Canada Day, July 1, 2009.

We have seen Policy No. CP97266 for Bond Coverage for employees in the
amount of $1,000,000.00 as per Section 287 (1) (b) as per S.O. 2001
c.25.

Council approves advertising in the Almaguin News as outlined in the
Sponsorship ad confirmation package as presented with each ad being $
20.00 plus GST unless otherwise stated.

The Council for the Village of Burk’s Falls have read and approve By-Law
No. 1-2009 Being a by-law to authorize the borrowing from time to time
to meet current expenditures during the fiscal year.
And that we authorize the Reeve and the Clerk to sign this by-law and
affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls have read and approve By-Law
No. 2-2009 Being a by-law to provide interest to be charged for overdue
payments – Tax Arrears.
And that we authorize the Reeve and the Clerk to sign this by-law and
affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls have read and approve By-Law
No. ¬¬¬¬3-2009 Being a by-law to establish a charge for interest for
non-payment of current taxes;
And that we authorize the Reeve and the Clerk to sign this by-law and
affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls have read and approve By-Law
No. 4-2009
Being a by-law to provide for an interim tax levy and the payment of
Interim taxes for the year 2009.
And that we authorize the Reeve and the Clerk to sign this by-law and
affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls have read By-Law No. 5 -2009
being a by-law to enter into an agreement with the Township of Ryerson
and the Township of Armour for the joint management and operation of the
TRI R Landfill and Recycling Site;
And that Council authorizes the Reeve and the Clerk to sign this by-law
and affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls have read By-law No. 6 -2009
being a by-law to confirm the proceedings of Council at its meetings
from July 2008 to December 2008;
And that Council authorizes the Reeve and the Clerk to sign this by-law
and affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls give a donation in the
amount of $1500.00 to the Almaguin Cup Committee for the 2009 event.

The Council for the Village of Burk’s Falls approves the annual grant to
the Burk’s Falls Cemetery in the amount of $ 150.00 for the year 2009.

The Council for the Village of Burk’s Falls pay the annual membership
fee to the East Parry Sound Veterinary Unit in the amount of $ 100.00.

The Council for the Village of Burk’s Falls approves the annual grant to
the Huntsville Branch of the Salvation Army in the amount of $ 50.00 for
2009.

2009-20
B. Campbell – Lewis Hodgson
Council for the Village of Burk’s Falls approves a donation in the
amount of $ 150.00 to the East Parry Sound Regional Science Fair.

2009-21
Lewis Hodgson – B. Campbell
By S.O. 2001 c.25 as amended, Section 284 (1) the treasurer of a
municipality shall in each year on or before March 31 provide to the
Council of the municipality an itemized statement on remuneration and
expenses paid in the previous year to: each member of council in respect
of his/her services as a member of the council or any other body,
including a local board, to which the member holds office by virtue of
being a member of council; each member of council in respect of his/her
services as an officer or employee of the municipality or other body
described in clause (a); and each person other than a member of council
appointed by the municipality to serve as a member of any body,
including a local board, in respect of his/her services as a member of
the body.
And that By-Law 2005-8 identified the remuneration to be paid to council
members as per S.O. 2001, c.25 Section 284 (2).

2009-22
Ron Russell – Rex Smith
The Council for the Village of Burk’s Falls approves the applications
(2) to conduct raffle lotteries as presented by the Almaguin Cup
Committee provided all regulations are adhered to.

2009-23

The Council for the Village of Burk’s Falls approve the payment of the
annual membership fees to the Parry Sound Municipal Association in the
amount of $ 150.00 per year.

2009-24
B. Campbell – Lewis Hodgson
The Council for the Village of Burk’s Falls have read the resolution
circulated by the United Counties of Stormont, Dundas and Glengarry
expressing concern with the payment for indigent funerals under the
Ontario Works Acts;
And Council supports the request to amend the current policy to provide
financial assistance to cover funeral expenses for all needy
individuals, regardless of their age or whether or not they are
receiving support through Ontario Works or the Ontario Disability
Support Program, at the time of death;
And that Council forward our support to the Counties of Stormont, Dundas
and Glengarry for their presentation to the Minister of Community and
Social Services.

The Council for the Village of Burk’s Falls have read the resolution
circulated by the Municipality of Clarington regarding Lottery
Licensing;
And that Council supports the concerns expressed in their resolution;
and
Hereby request the Alcohol and Gaming Commission of Ontario to expedite
its Modernization of Charitable Gaming Project, in particular the
application, reporting and administration processes respecting Break
Open Tickets and Raffles;

The Council have read the resolution circulated by F.O.N.O.M. expressing
concern with the infrastructure investment gap per household for
Northern Ontario municipalities;
And that Council supports the request that the Province of Ontario
increase the Northern Communities Grant by $ 50.00 per household, to
ensure all Municipalities in the North will receive the necessary
“Required Support”;
And that we forward our support to F.O.N.O.M. for their presentation to
the Premier of Ontario.

As per the Municipal Act S.O. 2001, c. 25 as amended, 239(2) Council for
the Village of Burk’s Falls enters into a closed meeting at 21:05 to
discuss property issues.

As per the Municipal Act S.O. 2001, c. 25 as amended, 239(2) Council for
the Village of Burk’s Falls exits from a closed meeting at 21:30.

That we approve the Accounts Payable as presented up to and including
January 27, 2009 in the amount of $258,413.00 and hereby authorize the
Clerk/Treasurer to issue cheques for same.
