THE VILLAGE OF BURK’S FALLS
COUNCIL MINUTES

The regular meeting of the Burk’s Falls Council was held on Tuesday May 30, 2006 at 7:00 p.m. All members of Council were present. A notice was posted in all necessary media regarding the new fee structure of the Joint Building Committee.
Dr. Whiting, M.A.H., Brendan Hatton – Public Health Inspector and Sheila Marchant-Short – Program Manager from the North Bay Parry Sound District Health Unit, and John Negasanti from the MOE were present to discuss the West Nile Virus.
They presented Council with statistics from 2005 regarding the number of adult culex mosquitoes and larvae at the sewage lagoons. There are both short and long term solutions available. Short is to larvacide and John Negasanti from MOE explained the procedure of applying for an application. Long term would be to aerate the lagoons. Council will now have to form a plan of attack and relay it to Dr. Whiting. Paivi Abernathy and George Jessop also from the Health Unit were at this meeting to update Council on the Smoke Free Ontario Act that comes into effect on May 31, 2006.

Brian Darnbrough, By-Law Enforcement Officer gave his report updating Council on the Property Standards infractions.

Len Hall, Village Foreman then gave his report.

Mandy Henderson from the Almaguin Forester was also at this meeting

Cathy Still – Lewis Hodgson:
The Council for the Village of Burk’s Falls adopt the Minutes of the April 25, 2006 meeting as circulated and the May 10, 2006 meeting as read.

2006-082
Rex Smith – Cathy Still:
We approve the Accounts Payable as presented up to and including May 30, 2006 and have authorized the Clerk/Treasurer to issue cheques for same in the amount of $ 78,454.38.

Cathy Still – B. Campbell:
We approve a donation in the amount of $200.00 to the Almaguin Palliative Care Team.

That Council for the Village of Burk’s Falls give a donation in the amount of $ 750.00 to the
Friends of the Burk’s Falls Health Centre – Miles of Coins Campaign for 2006.

B. Campbell – Lewis Hodgson:
The Council for the Village of Burk’s Falls accepts the tender as presented from A & A Power Generation in the amount of $ 2820.00 plus taxes for Preventative Maintenance for Power Generation units located in the Village of Burk’s Falls.

The Council for the Village of Burk’s Falls accepts the proposal from Better Business Machine in the amount of $ 3895.00 for the supply of a photocopier Model Toshiba 232 as presented at a cost of $0.012 per copy.

Council for the Village of Burk’s Falls accepts the budget as presented by the Joint Building Committee in the amount of $ 175,000. for 2006.

The Council for the Village of Burk’s Falls approves the 2006 Summer Recreation Program Budget as presented in the amount of $ 23,495.00.
And that Council for the Village of Burk’s Falls approves the 2006 Theatre Budget as presented in the amount of $ 24,320.00.

The Council for the Village of Burk’s Falls have reviewed the application as presented by Robert A. Humphrey for a Driveway, Water and Sewer permit for Lot 15, Plan 47 James Street effective June 1, 2006;

And that Council approves the applications as presented provided all fees are paid in full.

We approve the application to conduct a Raffle Lottery as presented by Land of Lakes Junior Public School provided all regulations are adhered to.

Rex Smith – Cathy Still:
WHEREAS the Forestry Sector has consistently demonstrated a tremendous ability to create jobs and prosperity throughout Ontario; and

WHEREAS the forest industry in Ontario is at risk because it operates in one of the most expensive and least competitive jurisdictions in the world; and

WHEREAS one of the most significant factors reducing competitiveness are the second highest electrical rates in all of North America; and

WHEREAS forestry stakeholders can work together with government to develop a provincial electricity policy that will help restore the industry’s ability to compete; and

WHEREAS immediate action by the Government of Ontario on the electricity policy is critical to the future of Ontario’s economic prosperity; now

THEREFORE BE IT RESOLVED THAT to keep people working, the Council for the Village of Burk’s Falls requests that the Ontario government act immediately to implement a two-stage forestry sector energy competitiveness plan that:
a) by June 2006 provides a $15. Per MWH rebate to the forest industry sector, retroactive to January 1, 2006, on purchased electricity;
b) by September, 2006 achieves an all-in target rate of $ 45 per MWW to remain established for a three year period from 2006 to 2009. The $ 15 rebate program will remain in effect until September 2006 or until te all-in delivered electricity rates for each facility has been established at the target rate of $ 45 MWH inclusive of all generation, transmission, DRC and other charges.

And that our resolution be directed to Premier McGuinty, the Honourable Dwight Duncan, Minister of Energy for consideration

The Council for the Village of Burk’s Falls have reviewed By-Law 23-2003 being a Municipal Accessibility By-law;
And that council recognizes and approves the recommendations prepared in the Addendum to this by-law;
And hereby authorize the Clerk/Treasurer to address the concerns stated.

Rex Smith – B. Campbell:
The Council for the Village of Burk’s Falls have read By-Law 14-1993 being a by-law respecting construction, demolition and change of use permits and inspection of same.

And that Council for the Village of Burk’s Falls have reviewed the Revised Schedule “B” Permit Fee Schedule.

Now therefore the Council for the Village of Burk’s Falls approves the revised Permit Fees as presented and attach Schedule B to By-Law 14-1993 effective June 1, 2006.

Council for the Village of Burk’s Falls have read and approve the amendment to By-Law 5-2006 being a by-law to appoint certain officers and set the rates of pay;

And that Council authorizes the Reeve and the Clerk to sign this amendment and affix the seal of the Corporation thereto.

The Council for the Village of Burk’s Falls have read and approve By-Law 9-2005 being a by-law to appoint a Chief Building Official.
And that council authorizes the Reeve and the Clerk to sign this by-law and affix the seal of the Corporation thereto.

And that we authorize the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

Council has reviewed the 2006 Contract between the Village of Burk’s Falls and Brian Darnbrough as the Municipal By-Law Enforcement Officer effective June 1, 2006;

And that this contract effective June 1, 2006 be attached to By-law 10-2005 as Schedule A.

And that Council authorizes the Reeve and the Clerk/Treasurer to sign this contract on behalf of the Municipality and affix the Seal of the Corporation thereto;

B. Campbell – Lewis Hodgson:
The Council for the Village of Burk’s Falls have read the resolution presented by the Municipality of Leamington expressing concerns with the existing methodology of selecting projects eligible for funding pursuant to the COMRIF program that it does not provide for sustainability of aging infrastructure for the majority of rural communities in Ontario;

And whereas rural Ontario municipalities are more than capable of identifying aging infrastructure in their community;

And whereas rural Ontario municipalities could upgrade their aging infrastructure and develop long range plans if a program was developed which provided funding to all municipalities on a yearly basis;

And that Council forward its support to the Municipality of Leamington for their presentation to the Federal and Provincial Governments requesting a program that will support infrastructure sustainability by providing a yearly stream of funding to all rural municipalities.

That the Village of Burk’s Falls spend up to $ 500.00 to further look into Geographic Information Services in conjunction with neighbouring municipalities.
